1. Who We Are
PeoplePulse is a product of NextGen Intelligence LLC, a limited liability company incorporated in the United States, with its principal place of business at 733 3rd Avenue, Floor 16 #1078, New York, NY 10017, United States. References to "PeoplePulse", "we", "us", or "our" in this policy refer to NextGen Intelligence LLC and the PeoplePulse service available at peoplehr.click.
We are committed to protecting the personal information of everyone who interacts with our platform. This Privacy Policy explains what data we collect, how we use it, who we share it with, and what rights you have — including rights under the South African Protection of Personal Information Act (POPIA), the European Union General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA).
2. Information We Collect
We collect information in the following ways:
2.1 Information you provide directly
When you register for a PeoplePulse account, start a free pilot, or contact us, we may collect your name, business email address, company name, job title, phone number, and billing information. Payment card details are processed exclusively by Stripe, Inc. and are never stored on our servers.
2.2 Information collected automatically
When you visit our website or use the PeoplePulse platform, we automatically collect certain technical information including your IP address, browser type and version, operating system, referring URLs, pages visited, and timestamps. We use Google Analytics to aggregate this data for product improvement purposes.
2.3 HR policy documents uploaded by customers
Customers may upload HR policy documents (such as employee handbooks, leave policies, or disciplinary procedures) to train their PeoplePulse assistant. We act as a data processor with respect to these documents — we read and index them to power the AI assistant, but we do not store employee personal data contained within them beyond what is necessary to provide the service. We do not use customer-uploaded documents to train general AI models.
2.4 Conversation data
When employees interact with a PeoplePulse assistant, conversation logs may be retained for a limited period to support quality assurance, error diagnosis, and product improvement. Conversation data is associated with the customer account, not with individual employees unless the customer configures employee authentication.
3. How We Use Your Information
We use the information we collect for the following purposes:

| Communication | To send transactional emails (receipts, account alerts, support responses) and, where you have opted in, product updates and marketing communications. |
| Product improvement | To analyse usage patterns, diagnose errors, and improve the accuracy and reliability of the PeoplePulse AI assistant. |
| Legal compliance | To comply with applicable laws, respond to lawful requests from authorities, and enforce our Terms of Service. |
| Security | To detect, prevent, and respond to fraud, abuse, and security incidents. |
We do not sell your personal information to third parties. We do not use your data for targeted advertising.
4. Legal Basis for Processing (GDPR)
For users in the European Economic Area and the United Kingdom, our legal bases for processing personal data are as follows:

5. POPIA Compliance (South Africa)
PeoplePulse serves customers in South Africa and is committed to compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). As an operator processing personal information on behalf of South African responsible parties (our customers), we:
- Process personal information only as instructed by the responsible party (the customer).
- Implement appropriate technical and organisational measures to secure personal information.
- Do not process personal information for any purpose other than as directed by the responsible party.
- Notify customers without undue delay upon becoming aware of a compromise of personal information.

6. CCPA Rights (California Residents)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):
- Right to know — the categories and specific pieces of personal information we have collected about you.
- Right to delete — personal information we have collected, subject to certain exceptions.
- Right to correct — inaccurate personal information we maintain about you.
- Right to opt out — we do not sell personal information, so there is nothing to opt out of.
- Right to non-discrimination — we will not discriminate against you for exercising your CCPA rights.

7. Data Sharing and Third Parties
We share personal information only in the following circumstances:

| Google Analytics | Aggregated website usage analytics. Data is anonymised where possible. |
| Cloud infrastructure providers | Hosting and data storage (US-based, SOC 2 compliant). |
| Legal authorities | Where required by law, court order, or to protect the rights and safety of PeoplePulse, our customers, or the public. |
We do not share personal information with advertisers, data brokers, or any third party for commercial purposes.
8. Data Retention
We retain personal information for as long as your account is active or as needed to provide the service. Upon account termination, we will delete or anonymise your personal data within 90 days, except where we are required to retain it for legal, tax, or audit purposes. Uploaded HR policy documents are deleted within 30 days of account termination.
9. International Data Transfers
PeoplePulse is operated from the United States. If you are located outside the US — including in South Africa, the European Economic Area, or the United Kingdom — your personal information will be transferred to and processed in the United States. We rely on appropriate safeguards (including Standard Contractual Clauses for EEA transfers) to ensure your data is protected in accordance with applicable law.
10. Security
We implement industry-standard technical and organisational security measures to protect your personal information, including encryption in transit (TLS) and at rest, access controls, and regular security reviews. However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.
11. Children's Privacy
PeoplePulse is a business-to-business service not directed at individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact [email protected] and we will delete it promptly.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a prominent notice on our website at least 14 days before the changes take effect. Your continued use of PeoplePulse after the effective date constitutes acceptance of the updated policy.
